A file destruction is completed by the RCMP. To start the process of file destruction, the request MUST be made with the arresting police force who will review the information on file, and if they approve your request, the arresting police force will contact the RCMP who will remove it from the Canadian Police Information Centre (CPIC) database, away from the eyes of the public.
File Destruction

File Destruction
The RCMP handles file destruction procedures. To initiate the file destruction process, the request MUST be submitted to the arresting police force. They will assess the information on file, and if your request is approved, the arresting police force will then coordinate with the RCMP to remove it from the Canadian Police Information Centre (CPIC) database, ensuring it is no longer accessible to the public

Record Suspension and Pardon are advantageous for individuals with charges leading to non-convictions or adverse information hindering their ability to progress positively in life. Removing this information from public view safeguards against its potential use in the future, particularly when applying for jobs, obtaining licenses, crossing borders, becoming bonded, returning to school, or pursuing adoption.
Unleash Your Potential

Each city's process time is different and can be complex, requiring individuals to provide evidence and justify why the information should be removed from the RCMP and local law enforcement database. Overall, file destruction with the RCMP can be a useful tool for individuals looking to move on from past mistakes and clear their records.
If you possess any of the following outcomes without any accompanying convictions, and the stipulated waiting period has lapsed, you qualify to request the expungement of records from the apprehending law enforcement agency. The decision to grant your request lies at the discretion of the arresting police.

Absolute Discharge:
This verdict acknowledges guilt from a court, yet no conviction is officially recorded, and there is no imposition of punishment. No specific conditions are tethered to an absolute discharge, and the individual does not incur a criminal record.

Conditional Discharge:
This ruling signifies a court's acknowledgment of guilt without officially registering a conviction or imposing punishment. Instead, the offender may be subject to specific conditions set by the court. Failure to comply with these conditions may lead to a court conviction. Upon fulfilling the conditions, however, the individual avoids acquiring a criminal record.
Stay:
This court-issued order halts the prosecution of a criminal case, if one year has passed and no additional action has been initiated by the crown, a file destruction can be sought.

Withdrawal:
This is a decision by the Crown prosecutor to terminate a criminal case before it reaches trial. A withdrawal may be executed with or without prejudice. A withdrawal with prejudice implies that charges cannot be reinitiated, while a withdrawal without prejudice means charges can be reinstated later.
If any of the aforementioned scenarios involve a conviction, eligibility for File Destruction is forfeited. Instead, a Record Suspension is pursued, sealing all information on your criminal record.
